Terms of Service

ATTORNEY REVIEW REQUIRED. These terms are a draft template and have not been reviewed by counsel. Before relying on these terms in any commercial relationship, Dispatch Rail LLC will have them reviewed and customized by Wyoming counsel.

1. Acceptance

By using dispatchrail.com ("the Site") or any service offered by Dispatch Rail LLC ("Dispatch Rail," "we," "our"), you agree to these Terms of Service ("Terms") and our Privacy Policy.

2. Eligibility

You must be 18 years or older and authorized to act on behalf of a U.S. motor carrier. By submitting any form on the Site, you confirm that the contact information you provide is accurate.

3. What Dispatch Rail does

Dispatch Rail provides dispatch services for U.S. motor carriers operating under their own MC and DOT authority. We are not a freight broker, we do not take title to freight, and we do not pay carriers — your factoring partner does that.

4. Pricing & payment

Pricing is a flat per-equipment weekly fee. Payment is accepted on any Stripe-supported rail (ACH, debit card, credit card, Apple Pay, Google Pay, Cash App Pay, Link by Stripe); processing fees are passed through at Stripe's actual cost. Billing is anchored to the day you activated — your first invoice covers 8 days (1 free setup day plus 7 days of dispatch service); subsequent invoices cover standard 7-day cycles on your anchor day. We do not charge a percentage of your linehaul. We do not bill monthly. We do not accept wire transfer, certified funds, PayPal, Zelle, Venmo, BNPL, crypto, paper check, or in-person cash. Dispute resolution. Your service is prepaid. By signing up you agree to resolve any billing concerns with us first via the in-system dispute path before contacting your bank. The dispatch agreement § 13 sets out the chargeback waiver, $500 administrative fee for chargebacks initiated outside that path, and mandatory arbitration in Sheridan, Wyoming under AAA Commercial Rules.

Pause, cancel, reactivate. You may pause for up to 7 days at no fee, 8-28 days for a $95 reactivation fee, or 29+ days for $95 plus light re-verification. Cancellation requires 30 days' written notice; reactivation after cancellation requires a $95 fee and full re-onboard regardless of how long you've been away.

6. Acceptable use

You agree not to misuse the Site or our services, including by attempting to access non-public areas, scraping content, or impersonating another carrier or person.

7. No warranties; limitation of liability

The Site and our public marketing materials are provided "as is." Service-level commitments, if any, are set out in your separate service agreement once you become a customer. To the maximum extent permitted by law, Dispatch Rail's aggregate liability is limited to fees paid to Dispatch Rail in the prior 30 days.

8. Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws principles. Disputes arising under these Terms will be resolved exclusively in the state or federal courts located in Sheridan County, Wyoming.

9. Changes

We may update these Terms. The "Last updated" date above will reflect the most recent change. Continued use of the Site after a change constitutes acceptance of the updated Terms.
